1. Definitions

"Service" refers to the AI integration consulting, development, and training services provided by Pulsarix. "User" or "You" refers to any individual or organization accessing our website or engaging our services. "We," "Us," or "Our" refers to Pulsarix, a company registered in Bangkok, Thailand. "Agreement" refers to these Terms and Conditions together with any service-specific contracts. "Content" refers to all text, images, data, and materials on our website and deliverables.

2. Acceptance of Terms

If you do not agree with any part of these terms, you should not use our website or services. You must be at least 18 years of age and have the legal capacity to enter into binding agreements in your jurisdiction. If you are engaging our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

3. Service Description

Pulsarix provides AI integration services including proof of concept development, intelligent workflow orchestration, and AI capability building programs. Services are available to organizations operating in Thailand and the wider Southeast Asian region. The specific scope, deliverables, and timelines for each engagement are defined in individual service agreements or proposals that supplement these general terms.

4. User Responsibilities

When using our website and services, you agree to provide accurate and complete information when submitting forms or entering into agreements, use our website and services only for lawful purposes, not to attempt to disrupt, compromise, or gain unauthorized access to our systems, respect the intellectual property rights contained in our website and deliverables, and maintain the confidentiality of any project-specific information shared during an engagement.

You are prohibited from reproducing, distributing, or creating derivative works from our website content without written permission, using our services for any illegal or harmful purpose, misrepresenting your identity or affiliation when engaging with us, and attempting to reverse-engineer any proprietary methods or software provided as part of our services.

5. Intellectual Property

All content on our website — including text, graphics, logos, and design elements — is the property of Pulsarix and is protected by Thai intellectual property law. You are granted a limited, non-transferable license to access and view our website content for personal or internal business evaluation purposes. For project deliverables, intellectual property ownership and licensing terms are specified in each service agreement. Generally, you retain ownership of your data, and we retain ownership of our methodologies and reusable frameworks.

6. Payment Terms

Service fees are quoted in Thai Baht (฿) and are specified in individual service agreements or proposals. Payment terms, including due dates and accepted methods, are outlined in each service agreement. Unless otherwise stated, payments are due within 30 days of invoice date. Late payments may incur interest at 1.5% per month on outstanding amounts. We reserve the right to suspend services if payment is more than 30 days overdue.

7. Service-Specific Terms

Proof of Concept: Deliverables include a working prototype, performance report, and production readiness assessment. The POC is a demonstration of feasibility and does not constitute a production-ready system. Timeline and scope adjustments may be discussed if data quality or availability differs significantly from initial expectations.

Workflow Orchestration: Scope includes workflow mapping, decision logic design, system integration, testing, and operator training as outlined in the service agreement. Changes to scope during the project are handled through a formal change request process with associated cost and timeline adjustments discussed in advance.

Team Development: Program enrollment, participation requirements, assessment criteria, and certification standards are detailed in the program agreement. Certification is awarded upon successful completion of all required modules and assessments. Participant availability and commitment are the responsibility of the client organization.

8. Disclaimers

Our services are provided on an "as is" basis. While we apply professional skill and care to all engagements, we do not make representations or warranties regarding specific outcomes, revenue improvements, or performance targets unless explicitly stated in a service agreement. AI models and systems are inherently dependent on data quality, business context, and operational factors outside our control. Our website content is provided for informational purposes and does not constitute professional, legal, or financial advice.

9. Limitation of Liability

To the maximum extent permitted by Thai law, Pulsarix's total liability for any claim arising from or related to our services shall not exceed the total fees paid by you for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities. Force majeure events — including natural disasters, government actions, pandemics, and infrastructure failures — shall excuse performance obligations for the duration of the event.

10. Indemnification

You agree to indemnify and hold Pulsarix harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of our services, your violation of any third-party rights, or any data you provide that infringes on the rights of others.

11. Termination

Either party may terminate a service engagement in accordance with the terms specified in the relevant service agreement. We reserve the right to suspend or terminate website access for users who violate these terms. Upon termination of a service engagement, we will deliver any completed work, return your data as specified in the agreement, and securely delete project data within the timeframe outlined in our Privacy Policy. Sections of these terms that by their nature should survive termination — including intellectual property, limitation of liability, and indemnification — shall continue in effect.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from these terms or our services shall be subject to the jurisdiction of the courts of Bangkok, Thailand. Before initiating formal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of at least 30 days. If negotiation is unsuccessful, the parties may agree to submit the dispute to mediation before proceeding to litigation.

13. General Provisions

These Terms and Conditions, together with any service-specific agreements, constitute the entire agreement between you and Pulsarix regarding the subject matter herein. If any provision is found to be unenforceable, the remaining provisions shall continue in full effect. Our failure to enforce any right or provision does not constitute a waiver of that right. Pulsarix may not assign or transfer these terms without written consent, except in the event of a merger or acquisition. 14. Changes to Terms
